DATES OF PROMOTION: “The People’s Choice for Healthcare Delivery” Contest (the “Contest”) begins at 09:00 a.m. Eastern Time (“ET”) on Monday, November 12, 2012 and ends at 11:59 p.m. (ET) on Thursday, January 31, 2013 (the “Contest Period”).
Entry deadline: 31 January 2013.
ELIGIBILITY: To be eligible for entry into the Contest, the participant must be a legal resident of any of the 50 United States, or the District of Columbia, and must be 13 years or older at the time of entry (the “Entrant”). Employees and their immediate family members (parents, children, siblings, or spouse, regardless of where they live, or persons living in same household, whether related or not) of Regenstrief Institute, Inc., (the “Sponsor”), its contractors, scientists, affiliated scientists, parent institutions, consultants, representatives, marketing agencies, and any others, herein (the “Contest Entities”) engaged in the development, production, execution, or distribution of this Contest are not eligible to participate. This contest is void outside of the 50 United States, the District of Columbia, and wherever else contests are restricted or prohibited by law.
This Contest will allow consumers to participate in the science of improving healthcare delivery. Healthcare delivery is how we organize and provide comprehensive healthcare services – including medical evaluation, diagnosis, treatment, and follow-up – for individuals and populations. Entrants will be able to provide their ideas about how to improve the delivery of healthcare in the United States.
HOW TO ENTER: To enter the Contest, visit this Web site (http://www.thepeopleschoice.org/) during the Contest Period, complete the required steps, and submit an entry (collectively, the “Submission”).
1. Contest Entry Form: Complete all required fields on the Official Contest Entry Form, including first name, last name, physical address, telephone number, e-mail address, citizenship, and age. Entrants who are between the ages of 13 and 17 must obtain permission from a parent or legal guardian, and complete the guardian’s name and guardian’s e-mail address on the Entry Form.
2. Idea: Within the “My Idea” section of the Contest Entry Form, type or electronically paste your idea about how to improve the delivery of healthcare in the U.S. (the “Idea”). The Idea can be no more than 650 words and should address the following elements.
a. What is the rationale for the project?
b. What are the specific aims?
c. In what way is the proposed work innovative?
d. Will the project be feasible to conduct or implement within five years?
e. How could this work improve the quality or costs of healthcare?
f. What are the first steps to be conducted over a four-month period?
3. Submit: Click the “Submit” button to submit your Submission into the Contest.
GROUP SUBMISSION: If more than one individual participates in developing the Idea, then check the “Group entry” box. Groups must designate an Entrant and that Entrant would be the representative of the group. All names of individuals in the group should be provided in the “Group Entries” section. If a group Submission is selected as the winner, the Entrant designated as the representative would be the Grand Prize winner.
All Entrants consent to the use of their names, likenesses, biographical information, and voices in advertising or promotional activities worldwide, without additional compensation.
There is no limit to the number of Submissions per Entrant. Uploading your Submission to another website or social media site will void your Submission. Late Submissions will not be accepted. Sponsor is not responsible for lost, late, or incomplete Submissions. All Submissions must be submitted electronically by using the Web site for the Contest. All Submissions shall become the exclusive property of the Sponsor. Sponsor has no obligation to acknowledge receipt of any Submissions received. Submissions that (a) are determined by the Sponsor or the judges in their sole discretion to be indecent, offensive, inappropriate or morally objectionable, (b) illegal or are otherwise unfit for publication, or (d) violate these Official Rules will not be eligible.
By submitting a Submission, the Entrant: (i) warrants and represents that he or she has read these Official Rules, is eligible to participate in the Contest and agrees to be bound thereby; (ii) warrants and represents that all of the information provided in his or her Submission is accurate, (iii) warrants and represents that the Submission is the original work of the Entrant and does not violate any third party’s legal rights (including without limitation rights of copyright, trademark, or other intellectual property right, privacy or publicity), or any applicable law; (iv) represents and warrants that the Submission does not contain any disabling device, virus, worm, back door, or other disruptive or malicious code that may, or is intended to, impair the intended performance of, or otherwise permit unauthorized access to, hamper, delete, or damage any computer system, software, network or data; (v) consents to the use of his or her name or likeness by the Sponsor and its respective authorized representatives for promotional purposes in connection with the Contest (whether online, in print, or through any other media now known or hereafter developed), without additional compensation and unless prohibited by law; (vi) agrees that, if selected as the winner, Entrant will be solely responsible for all resulting tax consequences; and (vii) consents to allow Sponsor to use any information contained in the Submission for the purpose of providing Entrant with information about available products or services in accordance with applicable law.
JUDGING/WINNING: On or about February 12, 2013, all eligible Submissions will be judged and scored by a qualified panel of judges. Eligible Submissions will be judged based on the following criteria.
- Innovative idea that can have measurable impact for healthcare consumers
- Feasible to implement in the U.S. healthcare system within five years
- Compatible with Regenstrief Institute, Inc.’s mission to improve health through research that enhances the quality and cost-effectiveness of healthcare
The Submission with the highest total score will be deemed the Grand Prize winner. In the event of a tie, the Submissions involved will be re-judged by an additional judge who will serve as a tiebreaker and evaluate such tied Submissions according to the judging criteria. No telephone calls or correspondence will be accepted regarding judges’ selections.
In addition, Sponsor may, in its sole and absolute discretion, elect to promote and advertise any Submission from an Entrant(s). All judging of eligible Submissions will be under the supervision of a qualified panel of judges, whose decisions are final in all matters relating to the Contest.
GRAND PRIZE: One Grand Prize of: i) $1,000 cash to be awarded in the form of a check, and ii) a trip for Grand Prize winner to Indianapolis, Indiana for the Idea kick-off at the Indiana University School of Medicine and Regenstrief Institute, Inc. Trip includes: (i) round-trip coach-class airfare for Grand Prize winner from a major airport nearest to the Grand Prize winner’s residence to Indianapolis, Indiana, and ii) a maximum of three days and two nights standard accommodations at a hotel determined by Sponsor in its sole discretion. Note that the originally stated cash prize of $400 has been raised to $1,000.
Grand Prize has an Approximate Retail Value (“ARV”) of $2,150.
PRIZE CONDITIONS: Grand Prize is not transferable, and no cash redemption or substitution is allowed, except at Sponsor’s sole discretion. Grand Prize winner is solely responsible for all matters that may become due in respect to the Grand Prize, including all applicable federal, state, and local taxes. Sponsor reserves the right to conduct a research study and publish the findings of the Grand Prize winner’s “Idea”.
Except where prohibited, potential Grand Prize winner must sign and return within five business days of being notified, an affidavit of eligibility/liability/publicity release and W-9 form (the “Paperwork”), to claim the prize. If potential Grand Prize winner fails to sign and return the Paperwork within the required period, potential Grand Prize winner forfeits the right to the Grand Prize, and the Entrant with the Submission having the next highest score will be the Grand Prize winner. Grand Prize winner consents to use of his or her name, likeness, biographical information, and voice in advertising worldwide without additional compensation (Tennessee residents will not be required to sign a publicity release as a condition of winning a prize).
GENERAL RULES OF PARTICIPATION: This Contest is subject to all applicable federal, state, and local laws. By participating, Entrants agree to be bound by these Official Rules and the decisions of the Sponsor and waive any right to claim ambiguity in the Contest or these Official Rules. Sponsor is not responsible for lost, late, misdirected, undeliverable, or incomplete Submissions, whether due to system errors or failures, faulty transmissions, or other telecommunications malfunctions, or Submissions not received resulting from any hardware or software failures of any kind, lost or unavailable network connections, failed, incomplete or garbled computer or telephone transmissions, typographical or system errors and failures, faulty transmissions, technical malfunctions, or otherwise. Sponsor may prohibit an Entrant (or their parent or legal guardian if Entrant is not the age of majority in his or her state of residence) from participating in the Contest or winning a prize if, in its sole discretion, it determines that said Entrant is attempting to undermine the legitimate operation of the Contest by cheating, hacking, deception, or other unfair playing practices (including the use of automated quick-entry programs) or intending to annoy, abuse, threaten, or harass any other Entrants, Sponsor, or Contest Entities. If for any reason, this Contest is not able to be conducted as planned, including, but not limited to, by reason of infection by computer virus, bugs, tampering, unauthorized intervention, fraud or any other causes beyond the reasonable control of Sponsor which corrupt or affect the administration, security, fairness, integrity, or proper conduct of the Contest, then Sponsor reserves the right at their sole discretion to cancel, terminate, modify, or suspend the Contest and judge from those Submissions received up to the cancellation or suspension date. CAUTION: ANY DELIBERATE ATTEMPT BY AN ENTRANT OR ANY OTHER INDIVIDUAL TO DAMAGE THE WEB SITE OR UNDERMINE THE LEGITIMATE OPERATION OF THE CONTEST MAY BE IN VIOLATION OF CRIMINAL AND CIVIL LAWS,AND SHOULD SUCH AN ATTEMPT BE MADE, SPONSOR RESERVES THE RIGHT TO SEEK REMEDIES AND DAMAGES (INCLUDING ATTORNEY’S FEES) FROM ANY SUCH ENTRANT TO THE FULLEST EXTENT OF THE LAW, INCLUDING CRIMINAL PROSECUTION.
NO LIABILITY: By participating, Entrants agree to release, discharge, indemnify, and hold harmless the Sponsor, Contest Entities, and each of their respective officers, directors, employees, representatives and agents from and against any claims made by winners, Entrants, or any other third parties, related in any way to the operation of this Contest as well as any other claims, damages or liability due to any injuries, damages, or losses to any person (including death) or property of any kind resulting in whole or in part, directly or indirectly, from acceptance, possession, misuse, or use of any prize or participation in any Contest-related activity or participation in this Contest.
NOTIFICATION OF WINNER: The Web site will publicly list the name of the winner between April 1, 2013 and May 31, 2013.
